These Terms and Conditions of Sale (T&Cs) govern the relationship between K-MINARI SRL, a private limited company with its registered office at Chaussée d'Alsemberg 897, 1180 Uccle, Belgium, registered with the Crossroads Bank for Enterprises under number BE 1041.678.842, and any natural or legal person making a purchase via the website cartespokemon.com (hereinafter "the customer"). By placing an order on our website, you accept these T&Cs without reservation.
1. Purpose
These T&Cs set out the terms of sale of the products offered by K-MINARI SRL via the website cartespokemon.com. They govern every stage of the sale, from order to delivery and after-sales service.
2. Products
The products available for sale are those shown on our website at the time of ordering. Each product comes with a detailed description so the customer can learn its main characteristics. We do our best to ensure the images shown are accurate, but we do not guarantee a perfect match between the image and the product.
3. Prices
Prices shown on the website are in "EUROS" (€) and include the VAT applicable on the day of the order. Shipping costs are shown in addition when the order is confirmed. We reserve the right to change prices at any time, but products will be invoiced at the rates in effect when the order is confirmed.
5. Price fluctuations of Japanese TCG products
Prices of Japanese TCG (Trading Card Game) products, especially displays and single cards, can fluctuate significantly, particularly around their release date. These variations are often due to external factors such as limited availability, high demand or market changes.
K-MINARI SRL reserves the right to change the prices of these products at any time, including after they are listed and before an order ships, according to market changes. No refund of the price difference will be accepted if a price drops after ordering, nor in the event of a price change before or after delivery.
Prices shown at the time of ordering are guaranteed, except in exceptional circumstances where a price revision is necessary due to strong market fluctuations. In all cases, K-MINARI SRL will strive to maintain fair, competitive prices in line with the market context.
6. Orders
The customer can order directly via the website. Once the order is confirmed, a confirmation email will be sent to the address provided by the customer. We reserve the right to refuse or cancel an order in the event of an existing dispute or a product availability issue.
6.1 Cancellation
To cancel an order, the customer must contact customer service and exercise their right of withdrawal within 14 days of the order.
6.2 Promotional Offers
No combining offers: Unless expressly stated otherwise at the time of distribution, promo codes and discount offers can never be combined with any other promotion, sale, discount, special price or item already discounted on the website. Only one commercial benefit may be used per order.
7. Availability and quantity limits
Our product offers are valid as long as they are visible on the website and while stocks last. Some items may be subject to quantity limits per customer. If the customer does not respect these limits, K-MINARI SRL reserves the right to cancel part or all of the order concerned. If an ordered product is no longer available after the order is confirmed, we will inform the customer as soon as possible and offer either a replacement or a refund.
8. Pre-orders
When you place an order containing one or more pre-order items, the entire order will ship once all items are available. This means the shipment will go out when the last item in the order is in stock. If you'd like to receive some items sooner, we recommend placing separate orders for items available immediately and those on pre-order. Delivery times for pre-order items are estimates and may change depending on production or availability.
9. Payment
Purchases are paid online by bank card, PayPal or any other payment method offered on the website. Payments are secured by Shopify Payments/PayPal/Stripe. The order amount will be charged when payment is confirmed. In case of suspected fraud, K-MINARI SRL reserves the right to carry out additional checks before confirming the order. This may include requesting supporting documents or temporarily suspending the order. If the checks are inconclusive or irregularities are detected, K-MINARI SRL reserves the right to cancel the order and refund any amounts already paid.
10. Retention of title
Ordered items remain the property of K-MINARI SRL until full payment has been received, including any additional costs (shipping, taxes, etc.). In the event of total or partial non-payment, K-MINARI SRL reserves the right to demand the return of delivered items at the customer's expense. This transfer of ownership does not affect the transfer of risk, which occurs as soon as the customer receives the products.
11. Delivery
Orders containing only in-stock items are prepared and shipped within 2 to 3 business days, Monday to Friday, excluding public holidays. Delivery times shown when ordering are estimates and may vary depending on the time of year (Black Friday, Christmas...), the carrier, weather conditions or force majeure (strikes, blockades, natural disasters, etc.). K-MINARI SRL cannot be held responsible for delays attributable to the carrier or to situations beyond its control.
12. Right of withdrawal
In accordance with applicable law, the customer has 14 days from receipt to exercise their right of withdrawal on sealed products (display, booster, box, deck), without giving reasons. These products must be returned unopened, with their original shrink wrap or blister intact. Single cards and products sold without shrink wrap ("Pas Scellé" / No Shrink variants) are not taken back, except in case of established non-conformity. 13. Returns and refunds
After receiving and checking the returned products, K-MINARI SRL refunds the customer within 14 days, using the same payment method as for the order.
A restocking and payment fee of 10 % of the total order amount is deducted from the refund (covering in particular our non-refundable payment fees): the refund therefore amounts to 90 % of the total order amount.
The returned parcel will be kept for a maximum of 30 calendar days from its receipt at our premises. After this period, the parcel will be considered abandoned, with no possibility of refund or redelivery.
If the product delivered differs from the one ordered, return shipping costs are borne by K-MINARI SRL. Any claim (damaged parcel, missing, opened or non-conforming product) must be made within 7 days of delivery, together with an unboxing video, according to the rules described in our Return Policy.
14. Warranty and liability
Our products are covered by the legal guarantee of conformity and the guarantee against hidden defects, in accordance with the law.
If a product is defective or non-conforming, the customer may request an exchange or a refund. The liability of K-MINARI SRL cannot be engaged for damage resulting from misuse of the purchased product.
15. Personal data protection
Personal information collected when ordering is processed in accordance with our privacy policy. This data is used only to manage orders and will not be passed on to third parties without your consent, except where necessary to fulfil the order (for example, sharing information with the carrier).
Payment verification and fraud prevention: As part of our fraud prevention policy, K-MINARI SRL reserves the right to ask the customer for any additional proof of identity and address before final confirmation of their order. If there is no response or the documents do not comply, we reserve the right to cancel the order and issue a full refund. In accordance with the GDPR, once our team has completed the verification, the documents provided are immediately and permanently deleted from our servers.
16. Intellectual property
All elements of the website cartespokemon.com (texts, images, logos, etc.) are protected by intellectual property rights. Any full or partial reproduction of the website without the express permission of K-MINARI SRL is strictly prohibited.
17. Disputes - Mediation
In the event of a dispute, an amicable solution will be sought before any legal action. Failing agreement, the dispute will be brought before the competent courts of Brussels.
18 – Applicable Law – Jurisdiction – Mediation
The sale of the Products is governed by Belgian law.
19. Transaction security and fraud prevention
To combat online payment fraud and secure high-value transactions, K-MINARI SRL applies an enhanced verification procedure for all orders of €1,000 (one thousand euros) or more.
19.1. Request for supporting documents
For any order reaching or exceeding this threshold, the Company reserves the right to suspend shipment and make final confirmation of the order conditional on the Customer providing valid supporting documents:
- A copy of an official ID document (National ID card, Passport or Residence permit) in the name of the customer account holder and of the bank card used for payment.
- Proof of address less than three (3) months old (electricity, gas, water or landline phone bill) matching the billing or shipping address provided.
The Customer is expressly invited to hide or blur any unnecessary data on these documents (in particular the social security number if visible, or other billing details); only the surname, first name, date of birth, photo and address must be legible.
19.2. Non-compliance and cancellation
K-MINARI SRL undertakes to process these documents within a maximum of 5 business days of receipt. In the event that:
- The Customer refuses to provide the requested documents,
- The documents provided do not make it possible to establish with certainty the buyer's identity or the legitimacy of the payment,
- The documents provided prove to be non-compliant or falsified,
K-MINARI SRL will automatically cancel the order immediately. A full refund of the amounts paid will then be made to the original payment method within 5 days, without the Customer being entitled to any compensation.
19.3. Data protection and GDPR
In accordance with the General Data Protection Regulation (GDPR) and on the basis of K-MINARI SRL's legitimate interest in preventing bank fraud (Article 6.1.f GDPR), the data collected is strictly reserved for authorized staff responsible for payment security.
These documents are processed in a highly secure manner. They are never kept indefinitely or added to a marketing file: they are permanently and irreversibly deleted from our servers as soon as the order is confirmed and shipped.
20. Changes to the T&Cs
K-MINARI SRL reserves the right to change these T&Cs at any time. The new terms will apply to orders placed after they are published on the website.
